REVISES POLICY 010.0020 COMMUNITY USE OF SCHOOL FACILITIES (LAST APPROVED ON 11/13/2007)

 

1.0  COMMUNITY USE OF SCHOOL FACILITIES

 

It is the intent of the School Board to establish guidelines for community use of school owned facilities that are within guidelines set in State Code Annotated 53A-3-413 and 53A-3-414 as revised in 2008 by the Utah State Legislature.

 

1.1  Building and Grounds may be used free of charge if the event/activity is school related.  “School Related” will be determined by each individual building administrator.

 

1.2  Any use of school owned buildings or land will require liability and property insurance in an amount as set by Utah State Risk Management.  The insurance policy must list Uintah School District as an insured party and has to be acquired for use of each building or piece of land (i.e. If an entity chooses to use the grounds at Vernal Jr. High and Vernal Middle School, the insurance policy must provide coverage for both locations).

 

1.3  Any use of school owned buildings or land will require supervision as provided by the school district at the cost of the entity or group using the facility or grounds.

 

1.4  There will be no charge (except for Insurance and Building/Grounds Supervisor) for Building or land use if any of the following criteria are met for non-religious entities or groups:

1.4.1         Entity or group is not for profit and the event is for school aged (K-12) students

1.4.2        Political Caucuses

1.4.3        Government entities and its political subdivisions

1.4.4        Charitable Organizations

 

1.5  Charges will be kept to the lowest limit and as close to the actual cost of operation as can be reasonably estimated.  All charges will be established by the Board of Education and remain in effect until changed.  A schedule as currently adopted is available from the district or school building use official.

 

1.6  No tips, gratuities, or payments not specified in the contract will be offered or paid to any school employee.

 

1.7  The Board of Education reserves the right to make exceptions or to assess special charges for unusual functions or use of school buildings.

 

1.8  All building and/or facility requests that deviate from the approved fee schedule must be approved in advance by formal action of the Board of Education and may be in the form of a memorandum of understanding.

 

2.0  REGULATIONS GOVERNING THE USE OF SCHOOL FACILITIES

 

2.1              All non-school Organizations will submit the applicable contract, proof of insurance, and assessed fees prior to the facility or grounds being reserved.

 

2.2              Reservations for building or grounds use will not be accepted more than 6 months in advance.

 

2.3              If an event is scheduled less than 2 week in advance, the school building use official may reject use of the facility if in their opinion the proper requirements cannot be met prior to the event.  This determination includes the inability to schedule a building supervisor or other personnel needed for the event.

 

2.4              Sponsoring organizations or applicants will be charged for supervision from the time they enter the building until the building is cleaned and locked up.  Uintah School District will hire and the school building use official will assign a supervisor upon request.

 

2.5              Applicants are responsible for providing any additional supervision needed, i.e., police protection, parking supervision, etc.  District building use official can require any applicant or organization to furnish additional supervisors if it is in the best interest of Uintah School District.

 

2.6              Arrangements for any special equipment, facilities, or personnel shall be made at time rental contract is issued.

 

2.7              Smoking and alcoholic beverages are not permitted in school buildings or on school grounds.

 

2.8              Use of materials on walls, floors, or other parts of the building is prohibited without specific approval of school building use official.

 

2.9              Electrical equipment cannot be used without specific approval of district building use official and school building use official.

 

2.10          Rental contracts are non-transferable.

 

2.11          No refund shall be allowed unless the district building use official is notified five working days prior to use date on contract.

 

2.12          Applicant shall agree to pay all damage done any Uintah School District property, directly or indirectly related to the applicants use.

 

2.13          No outside properties or equipment may be brought into the building without prior approval of the district and school building use official. When permission is granted, such property or equipment shall be removed immediately following its use. The school board or its agent is not responsible for damages to such property or equipment.

 

3.0  RESTRICTIONS ON PUBLIC USE OF SCHOOL FACILITIES

 

3.1              Gambling, raffles, bingo, or other games of chance are unlawful and prohibited in school facilities.

 

3.2              Programs interfering with regular schoolwork or programs classified as a nuisance by school officials shall be prohibited.

 

3.3              No school facility shall be available for dances excepting those sponsored by the school or community school and approved by the building use official.

 

 

4.0  SUPERVISION

 

4.1              The school building use official is responsible to assign and provide supervision for the building during rental periods to see that policies are followed and that malicious damage is avoided.

 

4.2              A regular school foods service employee must be in attendance whenever the kitchen is used. The School Foods Service employee will be hired for the purpose of supervising use of equipment and cleaning according to standards of the Department of Health. The School Foods Service employee shall not prepare meals or assist unless prior arrangements have been made with her.

 

4.3              All foods used in banquets or luncheons and all other expenses incurred shall be accounted for separately from regular school programs. No food purchases for the regular school lunch shall be used in any banquet or special luncheon.

 

4.4              Emergency use of school facilities must be according to plans approved by the Board of Education or under direction of duly authorized government agencies empowered to commandeer school facilities.

 

4.5              The district/school reserves the right to reschedule or cancel any event.

 

5.0  SCHEDULE OF FEES

 

5.1              Rates and charges for use of school facilities shall be according to the schedule herein. This schedule is a part of the application for use of these facilities and it shall be uniformly applicable to all organizations.

 

5.2              Additional fees may be charged for use of special equipment and services.

 

5.3              Applications to use school facilities for personal fund raising activities must be made to the Board of Education.

 

5.4              In no event may the use of school owned property be used as a for profit venue on an on-going basis.

 

5.5              For use of a gymnasium, stadium, cafeteria, or auditorium (including the UHS little theatre) the hourly fee is $40. (lighting needed other than ordinary lighting will require an additional fee)

 

5.6              For use of a regular classroom the hourly fee is $10

 

5.7              For use of a computer lab the hourly fee is $40

 

5.8              The hourly fee for a building or grounds supervisor or a school foods service worker is $15

 

5.9              The hourly fee for an auditorium lighting/sound technician or computer technician is $25

 

5.10          The flat fee for use of the lights at the UHS football stadium is $300 per night in addition to the hourly rental fee for the stadium.

 

5.11          For high risk events, a retainer of $25,000 will be required half of which will be refunded after the event if no damage occurs.
